Bakers’ top tier litigation practice combines local knowledge and international experience on civil litigation for both domestic and foreign corporations. The firm’s lawyers have extensive experience in corporate disputes, white collar defence and multijurisdictional disputes.

The firm represented Microchip Technology in a cross border IP matter. The matter required coordination across the firm’s various offices as well as with several Chinese litigation firms.

Another transaction saw the firm represent fabless IC design company LSI Technology (Singapore) on patent infringement litigation. The team defended the client against accusations of infringement, and successfully sought a settlement between the client and the plaintiff.

Another transaction saw the team advising a national provider of aircraft maintenance on regulations concerning conflicts of interest by public servants. The firm also advised a multinational Integrated Circuit (IC) design company based in Taiwan on interpretation of patent infringement.

The firm defended a Japanese construction company in a tunnel construction by Taiwan High Speed Railway. In another dispute, the team acted for an international turnkey contractor in mediation held by the Public Construction Commission against a petroleum corporation.

The year ended with representation of a client in an arbitration case with respect to construction payments arising from a project in Southern Taiwan Science Park.

The firm was involved in several landmark cases, such as defending Taipei Fubon Bank (TFB) in a dispute involving financial covenants connected to its agreement with Sports Affairs Council. In another transaction, the firm defended HSBC in a lawsuit filed by an institutional investor for alleged missing information in the prospectus of a collateralised bond obligation issued by HSBC.

Lee and Li’s dispute resolution practice has extensive knowledge and experience in providing creative and tailor-made resolutions for each dispute, on litigation through to mediation.

The firm represented Jusung Engineering in a patent infringement lawsuit filed in 2004 where Applied Materials claimed damages of US$5.8 million in the first instance. The Taiwan Hsinchu District Court finally issued a judgment in 2011 to dismiss the plaintiff’s claim.

The strong year continued when the firm advised Motorola Electronics Taiwan and Nokia Taiwan in patent litigation filed by Maruone involving a patent relating to a camera lens module. Another notable highlight was advising French pharmaceutical company Sanofi-aventis to file a preliminary injunction against a local pharmaceutical company on the basis of a new crystalline form patent.

In September, the firm represented Applied Materials in an alleged patent infringement litigation initiated by Jusung Engineering. The firm also successfully represented a major client in defending a copyright infringement criminal proceeding initiated by Microchip.
