Baker & McKenzie retains its top tier ranking with another strong year representing some of the world’s best known brand names and trade marks. The firm’s international presence allows the practice to branch out on matters involving various global industry associations, and it actively assists on both contentious and non-contentious IP matters.

The firm represented Eli Lilly and Company in a major patent infringement action concerning pharmaceutical process patents. In this landmark case, the judgement of which is often cited by the Taiwan Intellectual Property Office (TIPO) in its training and IP seminars, the Bakers team was able to obtain a favourable decision in the district court.

In another deal highlight, the firm acted for Rohm & Haas Electronic Materials CMP Holdings in its defence against a patent cancellation action.

The firm acted on behalf of Seiko Advance in filing a petition to partially cancel the national registration for the trade mark ‘SEIKO’ in respect of goods in the name of Seiko Holdings Corporation.

Another matter involved advising Honda Vietnam when it was notified that Tho Huyen was using the sign ‘HONDA’, which was identical to the company’s protected trade mark.

Rouse Legal advised a multinational pharmaceutical company on a successful raid action that led to the prosecutor’s indictment of the defendants. This case was a rare chance for the court to impose real deterrent penalties in a jurisdiction not known for them.

Another highlight for the firm was advising Scotch Whisky Association in only the third foreign geographical indication to be protected in Vietnam. This complex matter took over two years to achieve, as the registration system is relatively new and very few foreign GIs have so far been registered.

Another notable transaction was successfully representing a leading Australian pharmaceutical company in an action against a Vietnamese company that registered a multitude of trade marks with the apparent hope of ‘warehousing’ back to the pharmaceutical company.

On another dispute, the firm represented Yahoo! Inc. when an infringer changed its name from ‘Yahooooo!!! Private Company’ to ‘New Net’ and removed all signs resembling the former name from its advertisement boards and name cards.
