Practice
A graduate of the Peking University School of Law (LL.M with High
Distinction, LL.D in Intellectual Property), Dr Wan has been advising
clients on foreign direct investments in China for 20 years. She was
voted one of “Asia’s Leading Lawyers” by Asia Law & Practice in 2002
and each year from 2004 to 2011, and also received its China Labour
Lawyer of the Year Award in 2003. Under her leadership, TransAsia was
voted by Chambers and Partners as the “
Law Firm of the Year” in China for 2010 and 2011 in the area of employment law.
Dr Wan is the first non-PRC national to serve as a Director of the China
Labor Law Studies Association, following her nomination in 1997 by the
PRC Ministry of Labor & Social Security (MOLSS, now known as the
Ministry of Human Resources & Social Security). In 2006, she was
nominated as a Director of the China Social Security Law Research
Association.
Dr Wan enjoys a pre-eminent reputation for her expertise in PRC
employment law, advising on issues including pre-employment screening,
employee recruitment and hiring, legal compliance, employment contracts,
employee handbooks, non-competition and confidentiality agreements,
intellectual property rights protection, social security and welfare
benefits, retrenchment, trade unions, stock options, expatriate
employment, labor dispute resolution, collective action and crisis
management.
She is also a recognised authority on PRC land, intellectual property and e-commerce law.
Alongside her legal practice, Dr Wan is an adjunct professor of
employment law at both the Peking University Law School in Beijing and
the Northwest University of Politics & Law Law School in Xi’an. She
is also a regular guest lecturer for Tsinghua University’s MBA program.
Legislative Roles
Dr Wan is often invited by the Chinese government to participate in
legislative drafting sessions and to comment on draft regulations,
particularly those relating to employment. In this context, she recently
advised on the
Regulations on Labor and Social Security Supervision, the
PRC Employment Contract Law and on amendments to the
Elderly Persons’ Rights Protection Law.
Publications
Dr Wan is the author of
China Labor and Social Security Law – Essential Facts Explained (1998), for which she received the China Labor Law Studies Association Silver Medal from the MOLSS.
Her other publications include
China Employee Wages – Statistics and Analysis (2001),
Legal Issues Relating to E-Commerce (2001) and
Handling Employment and Labor Disputes in China (2007). Dr Wan also was the chief editor for the English translations of
Interpretation of the Employment Contract Law (written by the Legislative Affairs Commission of the National People’s Congress Standing Committee) and
Using Employment Contracts Skillfully & Reducing Labor Disputes (written by Chen Peiyong, an expert on Chinese employment law).
She authored
Legal Issues Relating to Electronic Signatures in 2001, the first book written on this topic in China.
