Kwak & Co. was established in 2009 by Lead Partner, Kyung Jik Kwak, who served as a judge for over 13 years at various courts in Korea and practiced law as a senior partner at a major law firm in Korea for over 7 years before founding Kwak & Co.
Litigation & Arbitration
Kwak & Co. represents Samsung Heavy Industries in the biggest ever oil spill case in various venues, criminal, civil and maritime. In early 2011, Kwak & Co. successfully procured final confirmation by the Supreme Court in favor of a group of Korean individuals who relocated to a Singaporean company against criminal charges regarding trade secret and unfair competition as well as civil claims raised by the former employer.
Prior to founding Kwak & Co., KJ Kwak successfully represented as lead counsel a group of Korean major financial institutions against Samsung Group companies in the biggest ever civil case involving the interpretation of a certain agreement made for the purpose of compensation for damages stemming from the collapse of Samsung Motors. KJ Kwak also represented former KPMG Korean member firms against KPMG International in ad hoc arbitration under the Rules of UNCITRAL in Zurich; Pohang Steelers Football Club against FIFA in CAS arbitration; Samyoung Corp. against Gea Batignolles Technologies Thermiques in ICC arbitration in Paris; Korean Deposit Insurance Corp against Prudential Financial, Inc. in ad hoc accountant arbitration in London; and Mercury Corp. against Daewoo Telecom in the Korean Commercial Arbitration Board arbitration.
M&A/Corporate
Kwak & Co. has represented:
- Consus PEF 3 in the sale of its controlling shares in Medison Co., Ltd. to Samsung Electronics through an informal bidding process, which involved Korean as well as foreign bidders (2010-2011, approx. 280 billion KRW/ 260 million USD);
- Consus Asset Management Co., Ltd. in its joint acquisition of Kumho Life Insurance with Korean Development Bank (2009-2010, approx. 480 billion KRW / 450 million USD);
- A Korean listed company in its potential acquisition of a foreign-based chemical engineering company (2009-2010, contemplated size of approx. 80 million USD); and
- Various other small to medium size deals, both domestic and cross-border.

Prior to founding Kwak & Co., Lead Partner KJ Kwak advised E1 in its acquisition of Kookje Corp. (2007, approx. 850 billion KRW / 790 million USD) and Taekwang in its acquisition of Huchems Corp. (2007, approx. 140 billion KRW / 130 million USD)
PPP Project Financing
Kwak & Co. currently represents the sponsor in the development of 2400 MW BOT Coal-Fired Power Plant in Nam Dinh, Vietnam.
